1. Introduction

Welcome to VietPOS.AI ("Application", "Service"), operated by Viet Duc Tri Co., Ltd. ("Company", "we", "us"). By accessing or using the VietPOS.AI application, website (https://vietpos.ai), mobile app, or Telegram bot, you agree to be bound by these Terms of Service.

2. Description of Service

VietPOS.AI is an AI-powered Point of Sale (POS) management software that includes:

• Web-based POS software for sales management
• AI Telegram Bot for business queries and automated reporting
• AI Agent system (revenue alerts, inventory forecasting, debt reminders)
• Payment integration with VNPay, MoMo, VietQR
• Mobile application and related services
• Social media content posting via connected accounts (TikTok, Facebook, LinkedIn)

3. User Accounts

• You must provide accurate information when creating a VietPOS.AI account.
• You are responsible for maintaining the security of your login credentials.
• Each account is intended for a single individual or business entity.
• We reserve the right to suspend or terminate accounts that violate these terms.
• You must be at least 16 years old to use VietPOS.AI.

4. Intellectual Property

All content, designs, source code, trademarks, and the VietPOS.AI brand are the property of Viet Duc Tri Co., Ltd. You may not copy, distribute, or use them for commercial purposes without prior written consent.

5. User Data Ownership

• Your business data (products, orders, customers) belongs to you.
• We only access your data to provide the VietPOS.AI service and technical support.
• You may export all your data at any time.
• Upon service termination, data is retained for 30 days before permanent deletion.

6. Service Plans and Payment

• VietPOS.AI offers multiple plans: Basic, Standard, Professional, and VIP.
• Paid plans are billed monthly and can be cancelled at any time.
• 14-day free trial available for all paid plans.
• Refund available within 7 days if not satisfied.
• AI Agent is an optional add-on with separate pricing based on usage.

7. Acceptable Use

When using VietPOS.AI, you agree not to:

• Use the service for any illegal purposes
• Attempt to access other users' data or accounts
• Reverse engineer, decompile, or disassemble the software
• Upload malicious code or attempt to compromise system security
• Post content that violates applicable laws through our social media features

8. Social Media Integration

When using VietPOS.AI's social media posting features (TikTok, Facebook, LinkedIn):

• Content posted must comply with each platform's community guidelines.
• Content must not violate Vietnamese law or applicable international laws.
• You are responsible for reviewing and approving content before posting.
• We are not liable for AI-generated content that you have approved and published.

9. Limitation of Liability

We strive to maintain 99.9% service uptime for VietPOS.AI. However, we are not liable for:

• Damages caused by user's internet connectivity issues.
• Errors arising from third-party devices or software.
• Indirect or consequential damages arising from use of the service.
• Service interruptions due to force majeure events.

10. Termination

• You may terminate your VietPOS.AI account at any time.
• We may terminate accounts that violate these terms with prior notice.
• Upon termination, you may export your data within 30 days.

11. Changes to Terms

We may update these Terms of Service for VietPOS.AI. Significant changes will be notified via email or Telegram at least 30 days in advance. Continued use of the service constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes shall be resolved at the competent courts in Ho Chi Minh City, Vietnam.
